Kurita Loses Appeal, '08 Primary Ouster Stands

Former Democratic state Sen. Rosalind Kurita has lost an appeal in federal court of the state party's decision to void her 2008 primary win and select her opponent as the nominee.

As Betsy Phillips recalled back in May, Kurita had upset Democrats by voting for Sen. Ron Ramsey for Senate speaker in 2007. The following year, Tim Barnes challenged her in the Democratic primary, and although Kurita initially won by 19 votes, Democratic officials voided the results and selected Barnes as the party's nominee.

Today the U.S. 6th Circuit Court of Appeals upheld a federal judge's dismissal of her suit against the State Primary Board of the Tennessee Democratic Party, in which she sought to have her name reinstated on the general election ballot.
