Mercy Ministries Update: The PR Battle Moves to YouTube

Posted by Caleb Hannan on Thu, Oct 23, 2008 at 3:15 PM

The online fight between Mercy Ministries and its various detractors has always been spirited. Blogs like CynicSage, Against Biblical Counseling, and Mercy Ministries of America: Truth Will Out, represent part of a small, but vocal group of ex-Mercy graduates and interested parties willing to air their dirty laundry in public. But up until now, Mercy has been relatively silent. That changed last week, when Mercy shifted its counterattack into overdrive. Several YouTube users have been targeted on claims of copyright infringement. Mercy contends the clips are illegal; the aggrieved counter that the videos fall under the domain of "fair use." In the meantime, nearly all of the anti-Mercy videos once available have been taken down, replaced by hasty mash-ups like the one above, attempting to explain the fiasco. Naturally, both sides, and their lawyers, claim to be in the right. Since we're neither attorneys nor experts in copyright law, we'll be quietly watching from the sidelines and letting you know when the squabble resolves itself.

Caleb,
My videos have not been pulled, but then I was perhaps a bit stricter in their formating and most of them are copyrighted to me. On an interesting side note, Mercy removes any openly critical comments on their videos ( I have been polite) anything that is not sychophantic in nature.
Mercy's response to dissent seems to be to quash it rather than present evidence to back up their assertions.

The videos they are talking about were fair use - plain and simple.
By claiming copyright to the fair use videos, Mercy Ministries has put themselves in an extremely undesirable legal position.
Unfortunately the legal issues may fall upon whichever lowly staff member they had submit the false copyright claims, rather than Mercy Ministries management themselves.

Not only that Barry but I know for a fact Mercy does not own the copyright to the footage taken from Australian Television.

Mercy Ministries' actions are passive aggressive.
You should have written about what they did to Wikipedia too.

"Not only that Barry but I know for a fact Mercy does not own the copyright to the footage taken from Australian Television."
How about the interview done by the Sydney Morning Herald? I noticed that video was taken down by Youtube because of Mercy Ministries so-called copyright claims too.
That's crazy.

That video was actually the first one that was taken down off my (currently suspended) account. The Email I received from youtube said it was taken down October 14, 2008 at 7:16:54 PM.

And they are claiming their lawyer advised them to do this? Where do they find their lawyers, on the back of a Cornflakes pack?

Hey Caleb, you might want to check this out. Now Mercy is encouraging people to upload their promotional material to their own youtube channel.
And here I was thinking they get upset at that sort of thing.
