True. But Ferguson was a guerrilla, not regular army. As such he was tried, convicted and executed for murder - not war crimes. There were numerous soldiers, both north and south, who were tried and executed for various crimes during the war. Wirz was tried as a war criminal for conspiracy to destroy the lives of Union soldiers (whether fairly or unfairly is certain up for debate). No disrespect for Mr. Ferguson intended.
