This will be fun. Let's review some earlier posts:

yoyo - "It's doubtful that more than one minute passed between the blow from Brown that busted the officers eye socket and the first shot outside the car."

yoyo - "Here's the link to the report -with pictures - of the fractured orbital bone."

John - "The accused officer, beaten badly- fracture of the orbital socket."

John - "FOX reports again on orbital FXs and says X-Rays of face will be presented to the g-jury."

If you both had waited for the truth to come out, you wouldn't need to eat your words now.

I know that.

However on this board assumptions are being made, perhaps the most common, is MB was shot because he was black. This bit of information about the gang member, MB, could be factored in to one's analysis of what happened. Fair enough?

JC might be the first know-it-all to look at this.

It was not me that called him "the gentle giant."

Can a grand jury hear about a victim's (any victim) past history in making a decision to indict? I am asking.

My understanding of the law is that Brown's past record would not have been admissible if he had been arrested and tried for an assault in this case. What he may have done before does not mean he committed an assault now.

If he had been found guilty, his prior record could have been considered during the penalty phase of the trial.

notguilty, is this anywhere close to correct?

You joined the right-wing rush to believe a fake picture used to bolster the contention that the officer suffered a fracture. You chose not to wait for the actual facts, so you got caught passing on bad information and gloating about it.

Pragmatist: The CT scan wasn't fake, it just wasn't of the officer. (Hohoho!) I do believe that my only mention of the x-ray was that, in a different blog, I posted a link to the site that featured the x-ray, and I did it without comment. That being said, it is evident the officer suffered trauma to his face or he wouldn't have been x-rayed to start with. Odds are the source of that trauma was Michael Brown. Strangely enough, in most places it's a felony to strike an officer of the law. Also, it was probably a felony (assault) for MB to lay hands on the store clerk while robbing him, and it was likely a misdemeanor to block traffic by walking in the middle of the street. Michael Brown managed to commit three crimes in about fifteen minutes. Some people wonder why African American communities draw so much police coverage. I don't.
