Unless TN was a party to the case the SCOTUS reviewed, TN is not bound by the SCOTUS review.

That is not to say that given similar facts within the state of TN that the Supreme Court would not come to the same decision (how could they not?). What we have is tilting against windmills, rolling a boulder up a hill, delaying the inevitable and all.

This really pisses me off. My family set up shot at Jamestown and my fifth great grandfather was the chief justice of the supreme court who institutionalized the concept of judicial review into American law. Rick Womick really needs to read Life of Washington, an amazing biography written by John Marshall (who was very close friends with Bushrod Washington, nephew of George), and John Marshall: Definer of a Nation by Jean Edward Smith. I thin he would have a better understanding of how this country works upon doing so.

Will Rep. Womick indemnify the clerks for the damages and attorneys' fees that will result when they are sued for following his advice?
