What's the difference between a swat team in police gear and a swat team in military gear? There is none except in the public's perception. I would worry far more about the DOJ headed by a racist Attorney General, than I would about cops running around in humvees.

Met with Gibbons several years ago in Mae Beavers office about a THP issue that had potential to be a big headache for him and Trott. All he could say was, "this can't get to the media" over and over. He had no desire to actually resolve the wrong doing on in the THP at the time. Only worried about himself.

I really like the cool David Olney cover the art director, Elizabeth Jones, designed from Eric England's always intriguing photography. I'm wondering if her double-image with the guitar necks connecting was intentionally done to make it look like David Olney is a "Contender" in the ring?? If so, she is a genius!

I am from Memphis where Gibbons was the DA for many years. I'm disappointed to see that Gibbons' smug attitude has continued in Nashville. The largest rape kit backlog in the country accumulated during his tenure as DA (and while his deputy commissioner, Larry Godwin, was Police Director). Both refuse to discuss the subject and display a special kind of annoyance when asked any critical questions.

The question is how long?

Did the officer need to get up that morning and think, "I'm going to kill someone today."? Did he need to form the intent one minute before the shooting? 10 seconds? 1 second?

Even if first-degree murder doesn't apply, there are lesser levels of murder and manslaughter that might apply.

I hope the ultimate outcome of all this is that the shooting was justified, because that would mean Brown didn't die unnecessarily and Wilson would not need to face charges. However, I'm not going to let that hope cause me to jump to any conclusions.

The New Reoublic, a magazine that thinks Hitler was a light weight, now that is rich!

Malice and forethought can legally be satisfied in an instant. The fact as it now stands that Officer Wilson exited his car and apparently walked several steps, had time to expend many rounds, six of which were hits on Mike Brown, pretty much establishes his opportunity to achieve proper qualification for malice and fore thought. Do not forget, Officer Wilson is a trained and six year experienced LEO, and by law is required to exhibit proper restraint.

Will he be convicted, well, as illustrated on many previous occasions (Zimmerman for example) it is quite difficult to convict a white person for the murder of a black young man unless it is obvious. And especially in the current climate put forth by a suspect prosecutor and the realities of a Grand Jury. Will he be held liable in a federal civil rights action, THAT is where the truth just may come to the surface

How about addressing the real problem, gang and drug violence! How about addressing all the police officers that have lost their lives this year! How about admitting there is a problem within these "ghettos", that are breeding out this thug culture that thrives on stealing, intimidation, and terrorizing peaceful citizens. Oh but we have a police problem, yeah right, police killed compared to "unarmed" black teens is around 1000/1. If the police force in Fergusson didn't have the riot gear, all the looting would still be going unchecked today. Law enforcement has to be prepared for events like riots, when drug gangs are illegally receiving automatic weapons, why do liberal whiners insist that our police force only be armed with rubber bullets and pepper spray?

JC, murder requires "malice aforethought" which I doubt works here. I'm no lawyer and favor Wilson; this seems contrary to your thinking. Going for murder may have harmed any chance of convicting Zimmerman in Fla.

I believe if it can be shown MB attacked him, bruising his face and trying to get his gun the officer will go free. This assumes he is indicted. There are 9 whites on the g-jury. We know nothing of them.

And, then there is Missouri law which favors Wilson- from the NEW REPUBLIC:

"In Missouri, the burden doesn’t budge an inch, even after we know that the defendant has killed the victim. It doesn’t matter that there is certainty that Darren Wilson shot Michael Brown. As long as there is still the slightest possibility that Wilson acted in his own defense, Missouri law favors Wilson."

Anyone else have a comment about an outcome, a "vote" so to speak?
